Twilio Proof of Consent

This document serves as proof that Txt2Post has obtained proper consent from users before sending SMS messages, as required by Twilio's policies and applicable telecommunications regulations (including TCPA compliance).

About Txt2Post

Txt2Post is a voice-to-blog publishing platform. Our service transforms voice memo transcriptions into polished blog posts. You record voice memos on your iPhone (using iMessage voice transcription), then text the transcription to our dedicated phone number. Our AI processes your text and creates a blog draft, which you can review and publish from your dashboard.

1. SMS Messaging Consent

By providing your mobile phone number and agreeing to these SMS Terms during registration, you explicitly consent to:

  • Send SMS messages to Txt2Post: You will initiate contact by texting voice memo transcriptions to our phone number to create blog posts
  • Receive SMS messages from Txt2Post: You will receive automated replies including confirmations, draft notifications, and service updates

This consent is not a condition of purchase. Txt2Post is free to use with optional paid features. SMS messaging is the primary way to submit content, but you can also use our web dashboard to create posts manually.

2. Types of Messages & Business Purpose

Business Purpose: Txt2Post uses SMS to enable you to create blog posts from voice transcriptions. When you text us content, we process it and send you notifications about your draft. All messages serve the core purpose of our voice-to-blog service.

By consenting to SMS messaging, you agree to receive the following types of messages:

2.1 Content Submission Workflow Messages (Primary Use)

  • You initiate: Text your voice memo transcription to our dedicated phone number
  • We reply with confirmation: "Processing your draft... You'll receive a link when ready."
  • We send draft notification: "Your draft is ready! Review and publish: [dashboard link]"
  • Error handling: If processing fails, we notify you with details

2.2 Service Messages (Secondary)

  • Account security: Password resets, login alerts, important account changes
  • Registration issues: Notification if your phone number is not registered
  • Content policy: Alerts if submitted content violates our guidelines
  • Service updates: Critical announcements affecting SMS functionality

2.3 Message Frequency (Varies by Usage)

Typical Pattern: For each blog post you create via SMS:

  • You send 1 message: Your transcription
  • We send 2 replies: Confirmation + draft ready notification

Estimated frequency: If you create 3-5 posts per week via SMS, you'll receive approximately 6-10 reply messages per week. Service messages are rare (1-2 per month at most).

3. How to Opt Out

You may opt out of SMS messages at any time using any of the following methods:

3.1 Text STOP

Reply STOP, CANCEL, UNSUBSCRIBE, or QUIT to any message from Txt2Post. You will receive a confirmation message that you have been unsubscribed.

3.2 Update Settings

Log in to your account and navigate to Settings to disable SMS notifications or update your phone number.

3.3 Delete Account

Deleting your account will automatically stop all SMS messages.

3.4 Effect of Opting Out

If you opt out of SMS messages, you will no longer be able to submit content via SMS or receive publication notifications. You can still use the web dashboard to create and manage posts.

4. Message and Data Rates

Message and data rates may apply based on your mobile carrier's plan. Txt2Post does not charge for SMS messages, but your mobile carrier may charge you for receiving and sending text messages. Contact your mobile carrier for details about your specific plan.

5. Supported Carriers

Our SMS service is available on all major U.S. carriers, including:

  • AT&T, T-Mobile, Verizon, Sprint
  • Boost, Cricket, Metro PCS, U.S. Cellular, Virgin Mobile
  • And many other carriers

6. Help and Support

7. Phone Number Changes

If you change your phone number, you must update it in your account settings. Txt2Post is not responsible for messages sent to old phone numbers after you change carriers or transfer your number.

8. Privacy and Data Use

When you use SMS services:

  • We store your phone number to identify you and send notifications
  • Message content is processed by AI to create blog posts
  • We do not sell or share your phone number with third parties for marketing
  • SMS metadata (timestamp, delivery status) is retained for service operation

9. Service Availability

We strive to provide reliable SMS service, but we do not guarantee uninterrupted service. SMS delivery may be delayed or fail due to factors beyond our control, including carrier outages, network congestion, or device issues. We are not responsible for failed or delayed message delivery.

10. Prohibited Uses

You may not use our SMS service to:

  • Send spam, unsolicited messages, or marketing content
  • Submit illegal, harmful, or abusive content
  • Impersonate others or misrepresent your identity
  • Attempt to disrupt or overload the service
  • Use automated systems to send bulk messages

Violation of these terms may result in immediate account suspension or termination.

11. TCPA Compliance

Txt2Post complies with the Telephone Consumer Protection Act (TCPA) and related regulations. By providing your phone number and explicit consent during registration, you authorize Txt2Post to send automated SMS messages to the provided number. This consent is documented and retained in our systems.

12. Consent Documentation (For Regulatory Compliance)

Txt2Post maintains records of user consent for SMS messaging, including:

  • Date and time of consent
  • Phone number provided
  • IP address and device information at time of registration
  • Acceptance of these SMS Terms of Service
  • Explicit agreement to receive SMS messages (checkbox or affirmative action)

This documentation is maintained for regulatory compliance and audit purposes as required by Twilio, the FCC, and applicable telecommunications laws.

13. Changes to SMS Terms

We may update these SMS Terms from time to time. Material changes will be communicated via email or SMS notification. Continued use of the SMS service after changes constitutes acceptance of the updated terms.

14. Dispute Resolution

Any disputes related to SMS services are governed by the Dispute Resolution provisions in our Terms of Service.

Twilio Messaging Service Disclosure

SMS Platform: Txt2Post uses Twilio's messaging platform to deliver SMS notifications. By consenting to SMS messaging, you acknowledge that:

  • Messages are sent via Twilio's infrastructure and are subject to Twilio's service availability
  • Your phone number and message metadata are processed by Twilio in accordance with Twilio's Privacy Policy
  • Txt2Post has obtained proper consent as required by Twilio's Acceptable Use Policy

Explicit Consent Collection Process (TCPA & Twilio Compliant):

  1. Registration form: User completes account details (email, username, password) and checks agreement to general Terms of Service
  2. SMS consent modal appears: A separate modal displays detailed information about:
    • Txt2Post's business purpose (voice-to-blog platform)
    • What SMS messages will be sent (confirmations, draft notifications, service updates)
    • Message frequency estimates (2 messages per post submission)
    • How to opt out (reply STOP)
    • Data rates may apply
  3. User provides phone number: Required field in modal (cannot proceed without entering)
  4. User checks consent box: Checkbox is NOT pre-selected - user must actively check to consent
  5. User clicks "I Agree" button: Final affirmative action confirming explicit consent
  6. Consent documented: Timestamp, phone number, IP address, and consent acceptance logged for compliance

Important: The consent checkbox is never pre-selected. Users must take deliberate action to provide consent, ensuring compliance with TCPA regulations and Twilio's opt-in requirements.
